Granwel Technologies LTD — FarLink Terms of Service and End User Licence Agreement. Version 1.1. Effective 24 October 2026. Last updated: 24 October 2026.
These terms are a legal agreement between you and Granwel Technologies LTD for your use of FarLink. They are also the end user licence agreement for the FarLink apps. Please read them carefully, especially:
- section 12, which explains when we can suspend, restrict, disconnect or ban you;
- section 13, which explains that we can change, suspend or permanently discontinue any part of FarLink;
- sections 17 to 19, which limit our liability; and
- section 9, which explains subscriptions, renewals and free trials.
By downloading, installing, opening or using FarLink, or by creating an account, you agree to these terms. If you do not agree, do not use FarLink.
If you are a consumer, you have legal rights in relation to digital content and services that are faulty or not as described. Nothing in these terms affects those rights. Advice is available from Citizens Advice (citizensadvice.org.uk) or your local consumer protection body.

3. These terms and other documentsLink to this section
3.1 These terms apply together with:
- the FarLink Privacy Policy, which explains how we handle personal information and is not part of our contract with you;
- any plan details shown in the App or on the App Store when you subscribe; and
- for Apps obtained from the Apple App Store, the Apple Media Services Terms and Conditions, to the extent they apply to you.
3.2 If there is a conflict:
- section 26 (Apple App Store terms) takes priority over everything else in these terms, to the extent Apple requires; and
- otherwise these terms take priority over other documents, except where the law requires otherwise.
3.3 These terms replace Apple's Standard Licensed Application End User License Agreement for the FarLink Apps, as Apple permits for a custom licence agreement.
4. Who can use FarLinkLink to this section
4.1 Age. You must be at least 13 years old to create an Account. If you are under the age of digital consent where you live, you need your parent's or guardian's consent. If you are under 18, you need a parent's or guardian's permission to buy a Subscription. Your parent or guardian is responsible for your use.
4.2 Capacity. You must be able to enter into a binding contract. If you use FarLink for an organisation, you confirm that you have authority to accept these terms for it.
4.3 Eligibility. You may not use FarLink if:
- we have previously banned you, or terminated your access;
- you are prohibited from receiving it under the laws of the United Kingdom or any other applicable country, including sanctions laws; or
- you are located in a country or region where FarLink is not offered. FarLink is not offered in the European Economic Area (the European Union, Iceland, Liechtenstein and Norway).
4.4 Accurate information. You must give us accurate information and keep it up to date.
5. Your accountLink to this section
5.1 Creating an account. Accounts are created with Sign in with Apple. You are responsible for your Apple Account, including keeping its credentials secure.
5.2 One person per account. An Account is personal to you. You may not share it, sell it or transfer it, or let anyone else use it, except that the people you allow to use your own devices may use FarLink through them, under your responsibility.
5.3 Security. You are responsible for everything that happens under your Account. Tell us straight away if you believe it has been compromised. You can sign out of all devices and remove linked computers in the App.
5.4 Recovery phrase. Your synced computers are end-to-end encrypted with a key that only your devices and your recovery phrase hold. We cannot recover your synced computers if you lose all your devices and your recovery phrase. Keep your recovery phrase safe and private. We will never ask you for it.
5.5 Multiple accounts. You may not create multiple Accounts to get more free trials, get round plan limits, or evade a suspension or ban.
5.6 Inactive accounts. We may close Accounts with no Subscription that have had no sign-in and no linked computer online for three years.
6. Your licence to use the appsLink to this section
6.1 Licence. Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to:
- download, install and use the Apps on devices that you own or control, in line with these terms; and
- for Apps from the Apple App Store, do so on Apple-branded products as the Usage Rules in the Apple Media Services Terms allow.
6.2 Ownership. The Apps are licensed, not sold. We and our licensors keep all rights, title and interest in FarLink, and we reserve all rights not expressly granted to you.
6.3 Restrictions. Except as these terms allow or as applicable law permits despite this restriction, you must not:
- copy, modify, adapt, translate or create derivative works of the Apps;
- decompile, disassemble, reverse engineer or attempt to derive the source code, except to the extent the law (including section 50B of the Copyright, Designs and Patents Act 1988) allows and cannot be excluded by contract;
- rent, lease, lend, sell, sublicense, distribute, publish or otherwise make the Apps or the Service available to anyone else;
- remove, alter or obscure any proprietary notice;
- use FarLink to build a competing product or service;
- circumvent, disable or interfere with licence checks, plan limits, trial protection, security features or any technical measure; or
- access the Service other than through the Apps or interfaces we provide, or use bots, scripts or automated tools against the Service, except our documented data export.
6.4 Open-source components. The Apps include open-source software components licensed under their own terms, which are listed in the Apps or their documentation. Nothing in these terms limits your rights under those licences.
6.5 Updates. We may provide updates that fix problems, improve security, add or remove features, or comply with the law. Some updates may be required to keep using the Service. If you are a consumer, we will keep the Apps in conformity with these terms as the law requires.
7. The FarLink serviceLink to this section
7.1 What FarLink does. FarLink lets you view and control computers you are authorised to access, using the VNC/RFB protocol, either directly on your network or through the FarLink Cloud relay. FarLink also syncs your saved computers between your devices, lets computers be linked to your Account, and can change a computer's display resolution while you view it.
7.2 What FarLink relies on. FarLink works with screen-sharing software on your computers, such as macOS Screen Sharing or third-party VNC servers. Those are not provided by us, and their availability, security and behaviour are outside our control.
7.3 Local use. FarLink can be used on your local network without an Account. Features that use FarLink Cloud need an Account and, for some features, a Subscription.
7.4 No guarantee of compatibility. We do not guarantee that FarLink will work with every computer, operating system, VNC server, network, firewall or device.
8. Free plan, plan limits and fair useLink to this section
8.1 Free plan. The Free plan allows a limited number of saved computers (currently one) on your local network only, and does not include access from anywhere through FarLink Cloud.
8.2 Plan limits. Each plan has limits, which are shown in the App and may include:
- the number of computers;
- access from anywhere; and
- sync.
FarLink Pro currently allows up to 25 computers. We enforce limits in the App and on our servers. If your plan changes, computers above your limit may become locked until you upgrade or remove computers.
8.3 Fair use. FarLink Cloud is designed for personal and ordinary professional remote access. We may set reasonable technical limits, apply them, and slow, pause or end sessions that exceed them or that harm the Service or other users. Such limits may cover:
- relay bandwidth and session length;
- the number of simultaneous sessions;
- idle time; and
- request rates.
Prohibited uses include sustained bulk data transfer, running unattended high-volume streams, and using the relay as a general-purpose proxy, VPN or file-transfer service.
8.4 Changing plans and limits. We may change what each plan includes under section 13. If a change significantly reduces what a paid plan includes during your current billing period, section 13.4 applies.
9. FarLink Pro subscriptions, free trials and paymentLink to this section
9.1 Purchasing. FarLink Pro is sold as an auto-renewable subscription through the Apple App Store, in weekly, monthly and yearly plans. Apple is the merchant of record. Apple charges you, collects any applicable tax, issues receipts, and handles billing, renewals, cancellations, refunds and payment disputes under the Apple Media Services Terms. Subscriptions cannot be bought in the Windows or Linux Apps; an active Subscription on your Account applies to them.
9.2 Prices. Prices are shown in the App and on the App Store before you buy, in your local currency, including any tax Apple applies. We may change prices for future billing periods. Apple will tell you in advance and, where required, ask for your agreement. If you do not agree, you can cancel before the change applies.
9.3 Automatic renewal. Your Subscription renews automatically at the end of each billing period, at the then-current price, unless you cancel at least 24 hours before the end of the current period. Apple charges your payment method within 24 hours before the period ends.
9.4 Cancelling. Cancel in your Apple Account settings (on iPhone or iPad: Settings › your name › Subscriptions). Deleting the App or your FarLink Account does not cancel your Subscription. After cancelling, FarLink Pro continues until the end of the period you have paid for.
9.5 Free trials. Some plans include a free trial for eligible new subscribers.
- One trial per person. Free trials are limited to one per person, Apple Account, FarLink Account, device, computer and network, and are only for genuine evaluation.
- Our checks. We decide eligibility using the checks described in our Privacy Policy, which include Apple's DeviceCheck, device and computer identifiers, and network limits. A network used for four free trials is permanently refused further trials.
- If you are not eligible, the App offers the same plans without a free trial.
- If you start a free trial by getting round our checks (for example by using several accounts or devices, or by subscribing outside the App), we may:
- withhold FarLink Pro features until your first paid period begins;
- end the trial; and
- suspend or ban the accounts, devices, computers and networks involved, under section 12.
- Trials convert automatically. Unless you cancel at least 24 hours before a free trial ends, it converts into a paid Subscription and Apple charges you.
9.6 Refunds.
- Apple handles refunds of App Store purchases under its policies. Request them at reportaproblem.apple.com. We cannot issue refunds of App Store purchases directly, although we may ask Apple to do so where we decide a refund is appropriate.
- Your cancellation right. As a consumer in the UK or EU you may have a right to cancel within 14 days of buying digital content or services. You agree that the Service starts immediately and that your right to cancel ends, or is reduced, once you start using it, to the extent the law allows. Apple's refund policy may still give you a refund.
- Your legal rights are not affected. Nothing in this section affects your legal rights if FarLink is faulty or not as described.
9.7 Subscription status. We rely on information from Apple to decide whether your Subscription is active. If Apple reports a refund, chargeback or revocation, we may end access to FarLink Pro immediately.
9.8 Family Sharing. FarLink Pro is not available through Apple Family Sharing. Each person needs their own Subscription.
9.9 Taxes. Apple calculates and collects sales tax, VAT and similar taxes on App Store purchases.
10. Acceptable useLink to this section
10.1 Authorised access only. You may use FarLink only to access computers that you own, or that you have the clear and current permission of the owner or lawful operator to access. You must stop immediately if that permission is withdrawn.
10.2 You must not use FarLink, or help anyone else use it:
- Unlawfully: in breach of any law or regulation, including the Computer Misuse Act 1990, the Data Protection Act 2018 and UK GDPR, the Investigatory Powers Act 2016, the Fraud Act 2006, and their equivalents elsewhere;
- To gain unauthorised access to any computer, account, network or data, or to test, scan or probe the security of any system without permission;
- To monitor, record, track or spy on anyone without their knowledge and, where the law requires, their consent. This includes covert monitoring of partners, family members, employees or students, and stalkerware or similar uses;
- To commit fraud or scams, including "tech support" scams, account takeovers, payment fraud, or tricking anyone into giving you access to their computer;
- To harm children or access, create, store or share child sexual abuse material;
- To harass, threaten, defame or abuse any person;
- To infringe intellectual property or other rights, or to distribute content you have no right to distribute;
- To distribute malware, ransomware or harmful code, or to run botnets, crypto-mining or command-and-control infrastructure;
- To interfere with FarLink, our servers or networks, or other users, including through denial-of-service attacks, overloading, exploiting vulnerabilities, or getting round rate limits, plan limits, trial protection or bans;
- To resell, rent or share access to FarLink Cloud, or to operate FarLink as a service for third parties without our written agreement;
- To misrepresent your identity or your connection with any person or organisation, or to impersonate Granwel; or
- For high-risk uses: in any situation where a failure, interruption or error could lead to death, personal injury, or severe physical or environmental damage, such as operating medical devices, vehicles, aircraft, weapons, nuclear facilities or critical infrastructure control systems.
10.3 Workplaces and organisations. If you use FarLink to access computers belonging to an employer, school or other organisation, you must follow its policies. The organisation is responsible for informing and getting any consent required from people whose information may be visible.
10.4 Security research. If you believe you have found a security vulnerability in FarLink, report it to us at contact@granwel.com with "FarLink security" in the subject, and do not exploit it or disclose it publicly before we have had a reasonable chance to fix it. Good-faith research that follows this section and does not access other people's data will not be treated as a breach of these terms.
10.5 Reporting misuse. If you believe FarLink is being misused, including to access your computer without permission, tell us using section 1.2.
11. Your computers, your content and your responsibilitiesLink to this section
11.1 Your content. "Your content" means everything on, and transmitted from, the computers you connect to through FarLink, including screens, files, input, clipboard text and the details of your saved computers. You keep all rights in your content. You give us only the permissions we need to carry your sessions and store your encrypted sync records, for as long as is needed to provide the Service.
11.2 We do not monitor content. FarLink Cloud relays sessions without storing or inspecting them (see the Privacy Policy). We have no obligation to monitor your content and do not do so. We may act on information we receive about misuse.
11.3 Your responsibilities. You are responsible for:
- the computers you make available through FarLink, their screen-sharing software and settings, and their passwords;
- choosing strong passwords and keeping software up to date;
- turning off hosting when you do not need it;
- whatever you do on computers you access through FarLink, and any changes you make, data you view, copy or delete, and commands you run;
- having the right to access the information on your computers, including other people's personal information; and
- keeping your own backups. FarLink is not a backup service. You are responsible for backing up your computers, data and recovery phrase.
11.4 Resolution changes. Automatic resolution changes a computer's display settings while you view it and is designed to restore them afterwards. Restoring may not always be possible, for example after a crash or power loss, or with some displays, drivers or operating systems. You are responsible for checking and correcting display settings.
11.5 Wake-on-LAN, hosting and remote control. Remotely waking, controlling or changing a computer can have effects you do not intend, such as unsaved work being lost, applications being changed, or the computer being left unlocked. Use these features carefully.
12. Our right to suspend, restrict, disconnect, ban and terminateLink to this section
12.1 When we can act straight away. We may, at any time and without prior notice, take any of the actions in section 12.2 if we reasonably believe that:
- you have breached these terms, including section 10 (Acceptable use) or the trial rules in section 9.5;
- you, or anyone using your Account, have acted fraudulently, abusively or unlawfully, or used FarLink in a way that may cause harm to anyone;
- your Account, a device or a computer has been compromised, or is being used without authorisation;
- the action is needed to protect the security, integrity or availability of FarLink, our systems or other users;
- we are required to by law, a court, a regulator, Apple, or another lawful authority, or to avoid legal liability or a breach of sanctions;
- you have created or used several Accounts, devices, computers or networks to get more free trials or to evade plan limits, a suspension or a ban;
- a payment has been refunded, charged back or revoked, or your Subscription is not active; or
- you have been abusive, threatening or harassing towards our staff or other users.
12.2 What we can do. We may:
- immediately disconnect any session, or all your sessions;
- suspend or restrict your Account, or any feature, including FarLink Cloud, sync, the relay or linked computers;
- remove linked computers or revoke sign-in sessions and device credentials;
- withhold or end free trials, and refuse future trials;
- refuse service to, or ban, your Account and any devices, computers, installations, Apple Accounts and networks we reasonably associate with the conduct, temporarily or permanently; and
- terminate your Account and these terms.
12.3 Other reasons. We may also end your Account and these terms, or stop providing FarLink Cloud to you, for any other reason, by giving you at least 30 days' notice.
12.4 Proportionality and explanation. We will act proportionately. Unless the law, security or the risk of further harm prevents it, we will tell you what we have done and why, and how you can ask us to review the decision. You can ask for a person to review any suspension or ban (see section 28). If we find we made a mistake, we will reverse it.
12.5 Evading a ban. If we ban you, you must not create or use another Account, or use FarLink through someone else's Account, devices or networks. Any such Account may be closed without notice.
12.6 Refunds after we act.
- You breached these terms. If we suspend or terminate because you have breached these terms, you are not entitled to a refund of any Subscription fees, to the extent the law allows. We may also tell Apple about the breach.
- Other reasons. If we terminate under section 12.3 for a reason that is not your fault, and you have paid for a period you can no longer use, section 13.4 applies.
12.7 Our other rights. Our rights under this section are in addition to any other rights we have under these terms or the law.
13. Changes to FarLink and discontinuing FarLinkLink to this section
13.1 We may change FarLink. FarLink is continually developed. We may add, change, replace or remove any feature, function, plan, limit, supported platform, operating system version or third-party integration of the Apps or the Service, including where we:
- improve FarLink;
- respond to changes in technology, our providers or user demand;
- meet legal or regulatory requirements; or
- address security risks.
13.2 We may suspend or discontinue FarLink. We may temporarily suspend, or permanently discontinue, any part of FarLink, including FarLink Cloud as a whole, the relay, sync, accounts, subscriptions, any App or support for any platform, or FarLink entirely, at any time, for any reason, including commercial reasons.
13.3 Notice. Where reasonably practicable, we will give you at least 30 days' notice before:
- permanently discontinuing FarLink Cloud or FarLink as a whole; or
- making a change that significantly and negatively affects your use of a paid feature.
We may give less or no notice where:
- there is an urgent need to protect security or prevent harm;
- the law, a court, a regulator, Apple or a key provider requires it;
- a provider we depend on stops or changes its service; or
- the change is minor or does not harm you.
13.4 Paid periods.
- When this applies. We discontinue FarLink Pro or FarLink Cloud, or make a change that significantly reduces what a paid plan provides, and you are a consumer with a paid Subscription period you cannot use as a result.
- What we will do. We will stop further renewals. We will ask Apple to refund the unused part of your current paid period or provide another remedy the law requires. Where Apple cannot do this, we will provide a pro-rata refund ourselves.
- Your only remedy. To the extent the law allows, this is your only remedy for discontinuation or such a change.
- Business users. They are not entitled to any refund or compensation for discontinuation or changes, to the extent the law allows.
13.5 After discontinuation.
- Your data. Before FarLink Cloud closes, we will, where reasonably practicable, let you download your data. After closure we will delete it as the Privacy Policy describes.
- The Apps. They may continue to work on your local network without FarLink Cloud, but we do not promise that they will, or that they will receive updates, remain available for download, or stay compatible with future operating systems.
13.6 No liability for discontinuation. Except as section 13.4 and section 18 provide, and to the extent the law allows, we have no liability to you for any change, suspension or discontinuation under this section.
14. Availability, maintenance and supportLink to this section
14.1 No guarantee of availability. We aim to keep FarLink Cloud available, but we do not guarantee that it will be available at any particular time, uninterrupted, error-free or secure, or that it will meet any particular performance level. There is no service level agreement unless we agree one with you in writing.
14.2 Maintenance. We may suspend FarLink Cloud for planned or emergency maintenance, repairs and upgrades. We will try to keep interruptions short.
14.3 Factors outside our control. FarLink depends on things we do not control, including:
- your devices, computers and networks;
- the internet;
- Apple's services; and
- our hosting and network providers.
Sessions may be slow, interrupted or dropped.
14.4 Support. We provide reasonable support by email for the Apps and the Service, at our discretion and without any guaranteed response time. Apple has no obligation to provide support for the Apps (see section 26).
15. Third-party services and softwareLink to this section
15.1 FarLink works with, or relies on, services and software provided by others, including:
- Apple (Sign in with Apple, the App Store, iCloud Keychain and DeviceCheck);
- Microsoft (hosting);
- Cloudflare (network services); and
- the screen-sharing and VNC software on your computers.
15.2 Those services are governed by their providers' own terms and privacy policies. We are not responsible for them, for their availability or security, or for any changes their providers make, including changes that affect FarLink.
15.3 If a third-party service that FarLink depends on is changed, suspended or withdrawn, we may need to change, suspend or discontinue the affected parts of FarLink under section 13.
16. Intellectual property and feedbackLink to this section
16.1 Our intellectual property. FarLink, including its software, design, text, graphics, logos, names (including "FarLink" and "Granwel") and all intellectual property rights in them, belongs to us or our licensors. You may not use our names, logos or trade marks without our written permission.
16.2 Feedback. If you send us ideas, suggestions or feedback, you give us a perpetual, worldwide, royalty-free, irrevocable licence to use them for any purpose, without any obligation to you. You do not have to send us feedback.
17. DisclaimersLink to this section
17.1 Your statutory rights. If you are a consumer, the law gives you rights that the Apps and the Service are of satisfactory quality, fit for purpose, as described, and provided with reasonable care and skill. Nothing in these terms limits those rights.
17.2 No other promises. Apart from the promises in section 17.1 and any we make expressly in these terms, and to the fullest extent the law allows, FarLink is provided "as is" and "as available". We exclude all other warranties, conditions, representations and terms, whether express or implied by statute, common law or otherwise, including as to:
- merchantability, satisfactory quality and fitness for a particular purpose;
- non-infringement;
- accuracy, availability, compatibility and security; and
- uninterrupted or error-free operation.
17.3 No professional advice. Nothing in FarLink is professional, security or IT advice.
17.4 Security of remote access. Remote access carries inherent risks. We do not warrant that:
- FarLink, the relay or the computers you connect to cannot be accessed by unauthorised people;
- the screen-sharing software on your computers is secure; or
- your use of FarLink will prevent loss, theft or exposure of data.
18. Our responsibility for loss or damageLink to this section
18.1 Things we never limit. Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- for consumers, breach of the terms implied by the Consumer Rights Act 2015 or equivalent laws that cannot be excluded or limited; or
- any other liability that cannot be excluded or limited by law.
18.2 If you are a consumer.
- What we are responsible for. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if, when you agreed to these terms, both we and you knew it might happen.
- Private use only. FarLink is for domestic and private use. We are not responsible to consumers for any loss of profit, loss of business, business interruption or loss of business opportunity.
- Damage to your devices. If defective digital content we supply damages a device or other digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will repair the damage or pay you compensation. We are not responsible for damage you could have avoided by following our advice to install an update, by correctly following installation instructions, or by having the minimum system requirements.
18.3 If you are a business user. We are not liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:
- loss of profits, revenue, sales or business;
- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation;
- loss or corruption of data or information;
- business interruption;
- loss of use of computers or systems; or
- indirect or consequential loss.
19. Limits and exclusions of liabilityLink to this section
19.1 Things outside our responsibility. Subject to section 18.1, we are not responsible for loss or damage caused by:
- your breach of these terms, or your misuse of FarLink;
- anything you, or anyone using your Account or devices, do on a computer through FarLink, including changing, deleting or exposing data;
- the computers you connect to, their screen-sharing or VNC software, their security, or their configuration;
- unauthorised access to your Account, devices or computers that results from you not keeping your credentials, devices, recovery phrase or computers secure;
- loss of synced computers where you have lost all your devices and your recovery phrase;
- display settings not being restored, or a computer being woken, changed or left unlocked, except where caused by our failure to use reasonable care and skill;
- third-party services, the internet, or events outside our control (section 24); or
- any change, suspension, discontinuation, suspension of your Account or ban made in line with sections 12 and 13.
19.2 Overall cap. Subject to section 18.1, and to the extent the law allows, our total liability to you for all claims arising out of or in connection with FarLink or these terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of:
- (a) the total Subscription fees you paid for FarLink in the 12 months before the event giving rise to the claim; and
- (b) £100, for consumers, or £50, for business users.
19.3 Each limit is separate. Each exclusion and limitation in these terms is separate and independent and applies even if another does not.
19.4 Time limit for business users. Any claim by a business user must be brought within one year of the date the claimant became aware, or should reasonably have become aware, of the facts giving rise to it.
20. Your responsibility to usLink to this section
20.1 Business users. You will indemnify us and our directors, employees and agents against all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- your use of FarLink;
- your breach of these terms;
- your breach of any law or third-party right; or
- any access by you or your users to any computer or data.
20.2 Consumers. You are responsible for any loss we suffer as a result of your breach of these terms, your unlawful use of FarLink, or your unauthorised access to any computer or data, to the extent the law allows.
21. Ending these terms yourselfLink to this section
21.1 You can stop using FarLink at any time. You can delete your Account in the App (Settings › FarLink Cloud › Account › Delete account), and uninstall the Apps.
21.2 Deleting your Account does not cancel your Subscription with Apple. Cancel it in your Apple Account settings (section 9.4).
22. What happens when these terms endLink to this section
22.1 When these terms or your Account end for any reason:
- your licence to use FarLink Cloud ends, and we may close your Account and delete your data as the Privacy Policy describes;
- if we ended your Account because you breached these terms, your licence to use the Apps also ends, and you must stop using and delete them; and
- these sections continue to apply: 6.2, 6.3, 11.1, 11.3, 12.5, 12.6, 13.4 to 13.6, 16 to 20, 22 and 24 to 30, and any other provision that by its nature should survive.
22.2 Ending these terms does not affect any rights or remedies that either of us had before they ended.
23. Changes to these termsLink to this section
23.1 Why we may change these terms. We may change these terms, for example to reflect:
- changes in the law or regulatory guidance;
- changes to FarLink, our plans, pricing or providers;
- changes needed for security or to prevent misuse; or
- clarifications.
23.2 Notice. We will tell you about material changes in the App or by email at least 30 days before they take effect, unless the change is needed sooner for legal or security reasons.
23.3 If you do not agree. If you do not agree to a change, you can stop using FarLink and delete your Account before it takes effect. If you are a consumer with a paid Subscription, and the change significantly disadvantages you, section 13.4 applies to the remaining paid period.
23.4 If you keep using FarLink. Continuing to use FarLink after a change takes effect means you accept the changed terms.
23.5 Current version. The version number and dates at the top identify the current terms.
24. Events outside our controlLink to this section
24.1 We are not responsible for any delay or failure to perform our obligations caused by events outside our reasonable control, including:
- outages or changes of the internet, cloud, power or telecommunications services;
- failures, outages or changes of Apple or other third-party services;
- cyber attacks or denial-of-service attacks;
- natural disasters, extreme weather, fire, flood, pandemic or epidemic;
- war, terrorism, civil unrest, strikes or industrial action; and
- government action, sanctions, or changes in law.
24.2 If such an event happens, we will tell you where we can, and take reasonable steps to minimise its effect. If it continues for more than 60 days, we may discontinue the affected parts of FarLink under section 13.
25. Export controls and sanctionsLink to this section
25.1 FarLink includes encryption technology and may be subject to UK, EU, US and other export control and sanctions laws.
25.2 You confirm that:
- you are not located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions;
- you are not on, or owned or controlled by anyone on, any UK, EU, UN or US sanctions or restricted-party list; and
- you will not export, re-export or use FarLink in breach of those laws.
25.3 We may suspend or end your access immediately if we believe this section applies.
26. Apple App Store termsLink to this section
If you obtained an App from the Apple App Store, the following also applies, and takes priority over anything inconsistent in these terms:
26.1 Acknowledgement.
- These terms are between you and Granwel only, not Apple.
- Granwel, not Apple, is solely responsible for the Apps and their content.
- These terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in force when you accept them.
26.2 Scope of licence. Your licence to use the App is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms allow. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, as those terms allow.
26.3 Maintenance and support.
- Granwel is solely responsible for providing any maintenance and support for the App, as these terms say or as applicable law requires.
- You and Granwel acknowledge that Apple has no obligation whatsoever to provide any maintenance and support services for the App.
26.4 Warranty.
- Granwel is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App.
- To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever for the App.
- Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are Granwel's sole responsibility, subject to these terms.
26.5 Product claims.
- Granwel, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it. These include:
- (i) product liability claims;
- (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and
- (iii) claims arising under consumer protection, privacy or similar laws, including in connection with the App's use of the HealthKit and HomeKit frameworks (which FarLink does not use).
- These terms do not limit Granwel's liability to you beyond what applicable law permits.
26.6 Intellectual property claims. If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, Granwel, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
26.7 Legal compliance. You confirm that:
- (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and
- (ii) you are not listed on any US Government list of prohibited or restricted parties.
26.8 Developer name and address. Questions, complaints or claims about the App should be sent to Granwel Technologies LTD, Suite RA01, 195-197 Wood Street, London, E17 3NU, United Kingdom; contact@granwel.com.
26.9 Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your network provider's terms.
26.10 Third-party beneficiary.
- Apple and its subsidiaries are third-party beneficiaries of these terms.
- Once you accept these terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
27. Notices and communicationsLink to this section
27.1 How we contact you. We may send you notices and other communications by email to the address associated with your Account (including an Apple private relay address), or in the App. You agree to receive communications electronically, and that they satisfy any legal requirement for communications to be in writing.
27.2 How you contact us. You may send notices to us using section 1.2.
27.3 When notices arrive. A notice by email is treated as received when sent, unless we receive a notice that it was not delivered. A notice in the App is treated as received when displayed.
28. Complaints and disputesLink to this section
28.1 Complaints. If you have a complaint, including about a suspension, ban or trial refusal, contact us using section 1.2 with the details. We will acknowledge it within 5 working days and try to resolve it within 30 days.
28.2 Review of decisions. You can ask for a person at Granwel to review any decision to:
- refuse a trial;
- withhold Subscription features;
- suspend or ban an Account, device, computer or network; or
- end your Account.
We will consider anything you tell us, and confirm or change our decision.
28.3 Disputes. If we cannot resolve a dispute, consumers may be able to use an alternative dispute resolution service, or bring a claim in the courts (section 29). We are not obliged to use any particular alternative dispute resolution provider, but we will consider any reasonable proposal.
28.4 App Store purchase disputes. Disputes about App Store charges and refunds should be raised with Apple.
29. Governing law and jurisdictionLink to this section
29.1 Governing law. These terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or FarLink, are governed by the law of England and Wales.
29.2 Consumers. If you are a consumer:
- you may bring proceedings in the courts of England and Wales;
- if you live in Scotland, you may bring proceedings in Scotland or in England and Wales;
- if you live in Northern Ireland, you may bring proceedings in Northern Ireland or in England and Wales; and
- if you live in the European Union or elsewhere, you keep the protection of any mandatory provisions of the consumer law of your country of residence, and you may bring proceedings in the courts of your country of residence where that law allows.
29.3 Business users. If you are a business user, the courts of England and Wales have exclusive jurisdiction.
30. General termsLink to this section
30.1 Entire agreement. These terms, together with the documents referred to in section 3, are the entire agreement between you and us about FarLink, and replace any earlier agreements, arrangements or understandings. If you are a business user, you acknowledge that you have not relied on any statement or promise not set out in these terms.
30.2 Transfer by us. We may transfer our rights and obligations under these terms to another organisation, for example as part of a sale, merger or reorganisation of our business. We will tell you if this happens. If you are a consumer and are unhappy with the transfer, you may end these terms and delete your Account. Section 13.4 applies to any paid period you cannot use.
30.3 Transfer by you. You may not transfer your rights or obligations under these terms to anyone else without our written consent.
30.4 Third-party rights. Except for Apple and its subsidiaries under section 26.10, nobody other than you and us has any right to enforce these terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. We and you do not need anyone else's consent to change or end these terms.
30.5 Severability. If a court or other authority decides that any part of these terms is unlawful, invalid or unenforceable:
- that part is modified to the minimum extent needed to make it enforceable, or, if that is not possible, removed; and
- the rest of these terms stay in full force.
30.6 No waiver. If we do not insist on you doing something these terms require, or delay taking steps against you, that does not mean you do not have to do it, and it does not stop us doing so later.
30.7 Relationship. Nothing in these terms creates a partnership, joint venture, agency or employment relationship between you and us.
30.8 Language. These terms are written in English. If a translation is provided, the English version prevails where there is a conflict.
30.9 Interpretation.
- Headings are for convenience only.
- Words such as "including" and "for example" do not limit the words before them.
- A reference to a law includes that law as amended or replaced.
